Kyle Barnhill has arrived back in Nacogdoches

NACOGDOCHES, TX (KTRE) - The case of Kyle Barnhill could go to the grand jury as soon as this Friday, if the district attorney has her way.

"I would like to take it to the grand jury this Friday, but if everything isn't ready, it'll be ready for in a couple weeks," Nacogdoches County District Attorney Nicole LoStracco said.

Barnhill was transported from Eagle Pass by airplane to the Nacogdoches airport. The plane landed shortly before 8 p.m.  During a brief news conference at the airport, Nacogdoches Police Lt. Greg Johnson said Kyle Barnhill was cooperating with police, however, he said they have not discussed the case or questioned him about the case.  Lt. Johnson told reporter all they did was "pretty much talk about the weather."  He also said when they picked up Barnhill he had a few personal belongings and a few items that police will not disclose because it's evidence in the case.  He said they have not located a weapon or gun.

LoStracco said Barnhill will be booked in jail right away. A judge will review his bond, which was set at $750,000 for the murder charge and $20,000 for unauthorized vehicle use.

Barnhill had "multiple fresh scratches on his face, arms and upper body, which would consist with someone going through the woods" after the shooting death of Melissa Kesinger Barnhill, a police arrest affidavit stated.

The Nacogdoches Police affidavit also stated a witness saw a male running out of a wooded area behind Melissa Barnhill's house and driving off in a vehicle that matched the one Kyle Barnhill was driving.

Melissa Barnhill was shot to death on March 12 at her Kings Row home in Nacogdoches by a single gunshot to her neck from a bullet shot through her kitchen window while she was cooking a meal for her two small daughters.

The affidavit states Melissa Barnhill had "ongoing problems with her ex-husband Kyle Edwin Barnhill. Barnhill has made threats in the past to harm or kill Melissa."

Though the affidavit referred to Kyle Barnhill as Mellissa Barnhill's ex-husband, LoStracco said the two were legally married at the time of Melissa Barnhill's death.

Kyle Barnhill was arrested Monday without incident in Eagle Pass shortly after a first-degree murder warrant for his arrest was made.
