Center woman says husband forced her into sex with minor

NACOGDOCHES, TX (KTRE) - A woman who pleaded guilty Monday to two counts of sexual assault of a minor took the stand Tuesday in her sentencing testimony.

Tammy Butler said her relationship with the victim only happened because her ex-husband forced her to perform sexual acts with the victim.

Butler spoke of the abusive relationship she had with her ex-husband, Marlin, and how he had her perform sexual acts with other people.

She said she never intended for the relationship to become physical until the victim become of age and that they talked about moving in together when that happened. She said the victim had sex with her and her husband as a way to protect Butler.

Butler's testimony contradicted that of the victim's Monday, as Butler said they only had sex one time when her husband, Marlin, was not there.

Defense Attorney John Boundy was wanting Marlin Butler to answer questions about the threesomes, but under his attorney's advice pleaded the fifth, his right to silence.

Marlin Butler is also charged with sexual assault of a minor with the same victim.

"The questions that were asked of him today, even though they are in Tammy's case, are clearly designed to attack him and today is not his trial," his attorney, John Heath, said.

Tammy Butler had no trouble attacking her ex-husband. The divorce that was finalized Monday.

"He would beat me in front of my children until I couldn't get up and move. Almost every day," Tammy tearfully testified.

"He had me have sex with his friends so he could watch," she testified.

When asked why she didn't leave Tammy Butler said, " He told me, watch my back because he would kill me."

The teen testified she had sex with Tammy and Marlin because, "If he didn't get his way, he was going to make somebody pay for it."

"I didn't want anything bad to happen to her," the victim said.

The defense wants to portray Tammy Butler being victimized by a husband and a female lover. Tammy Butler testified she never wanted a physical relationship until the teen became of age.

Then a dark secret was unveiled. The prosecution had Tammy read her entry into one of seven journals the women kept about their relationship. She wrote to the teen, "I can't believe you told her about our animal sex and everything."

The prosecution asked Tammy, even though she loved the girl so much, she brought her into that abusive situation.

"Yes sir, I guess I did," Tammy Butler said, through sobs.
