LUFKIN, TX (KTRE) - The sexual assault trial of a Diboll man accused of molesting three underage girls began Wednesday in Angelina County District Court.
Kevin Massoth is accused of touching genitalia of three girls, aged 13, 14 and 15 at a Halloween party on Oct. 28, 2008.
According to the state's opening testimony, one of the girl's mother found out about the assault in February after her daughter asked her some sexual questions. The mother became suspicious and questioned her daughter about it and her daughter told her what happened.
The other two girls came forward about the alleged assault after that.
The defense is arguing that if the girls had really been sexually assaulted, it would not have taken them three months to come forward with the allegations.
The first victim, referred in court as "Jane Doe 1," and who was 15 at the time, said Massoth molested her twice at the party.
"The defendant pushed me into the wall and pulled my pants down," she said.
She went on to testify she was able to get away from Massoth, but he later was able to pull her away from the party and behind a house where they had sex.
"He grabbed me and held me down where I couldn't move," she said.
Defense Attorney Ryan Deaton, in cross-examination of "Jane Doe 1," pointed out discrepancies in her original statement to authorities and in testimony on Wednesday.
"This is not fun and games, you understand?" he asked.
"Jane Doe 2," who was 14 at the time of the party, said she saw Massoth touch the third victim.
"I saw Todd touch [her] on the her front private area," she said.
