LUFKIN, TX (KTRE) - An Angelina County jury found a Diboll man not guilty Friday on all three counts of indencency with a child. Family and friends of the defendant, Kevin "Todd" Massoth anxiously waited forindecencyusion of the case.
The jury took only 25 minutes to deliberate before coming back with the verdict.
Kevin Massoth, now age 18, was accused of molesting three girls, then aged 15, 14 and 13 at a Halloween party last year.
Defense Attorney Ryan Deaton said, "In a case this serious, if they're going to find a 17 year old boy guilty, they're going to spend time thinking about it."
The trial lasted over two days with numerous witnesses taking the stand for both the defense and the prosecution. Massoth took the stand himself on the second day of the trial tearfully proclaiming his innocence to the jury.
After the jury's verdict was read, the judge advised the young man to learn something positive from the situation.
Massoth's family was thrilled with the verdict which allowed them to walk out of the courthouse with him by their side. His mom was overwhelmed with emotion for her son.
"I felt like I was holding my baby again," described his mom, Sytha Massoth-Turney about hugging her son the first time after the verdict.
Massoth hopes to finish school, attend some type of college and possibly become a diesel mechanic. With the 'not guilty' verdict, he can achieve his dreams.
"I can start my life now. My life was on hold for this situation," Massoth said.
