LUFKIN, TX (KTRE) - A former DaVita nurse, charged with killing five dialysis patients, has requested an extra attorney for her upcoming capital murder trial.
Her current attorney, Ryan Deaton, said in district court today that he had agreed to be Kimberly Saenz's sole attorney unless the state decided to pursue the death penalty.
District Judge Barry Bryan granted the request and said he would seek a capital death attorney.
The trial is expected to begin in late July or the beginning of August.
Deaton will stay on the case as a co-counselor of Saenz.
