Court says Mineola child sex ring defendant should be retried

TYLER, TX (Raycom News Network) - A major development was made in the case of a convicted child molester.

Wednesday morning, the 14th court of appeals has decided to reverse the case of Patrick Booger Red Kelly.

Kelly was convicted to life in prison for his role in the alleged Mineola child sex ring.

In its opinion, the appeals court found the evidence in the case was sufficient to support the conviction.

But, the court reversed the case due to "numerous evidentiary errors by the trial court and improper closing argument by the state."

The Houston appeals court also reversed the case of Jaime Pittman. Pittman was convicted and sentenced to life in prison in March 2008 on one charge of aggravated sexual assault of a child.
