NACOGDOCHES, TX (KTRE) - A Nacogdoches man facing charges for his alleged role in an March 2009 eight-liner bust will be missing a hearing today due to his being hospitalized.
An employee in the district judge's office confirmed Allen Cunningham, 49, was checked into a Houston hospital. The reason for the hospitalization is not known.
Cunningham and his wife, Gayla, were charged with money laundering as part of an eight-liner raid the sheriff's office conducted. Gayla Cunningham accepted a plea deal in February and avoided jail time. Her husband, however, backed out of a plea deal in open court after he found out he would have to go to jail.
Allen Cunningham's lawyer, John Heath Jr., withdrew from the case after Cunningham during that plea hearing.
Friday's hearing was just supposed to be a status hearing, checking on where the case was and if Cunningham had hired a new attorney.
Prosecution for the case is being handled by the state attorney general's office.
