Rusk Co. DA handling Sheriff Kerss' wife's case

NACOGDOCHES, TX (KTRE) - When Codi Kerss used pepper spray while on Cushing school property back in May, everyone knew an investigation was in order. The problem was finding someone in Nacogdoches County to investigate the sheriff's wife and the former district attorney investigator.

Rusk County District Attorney Michael Jimerson is serving as prosecutor pro tem. Conflict of interests among Nacogdoches County attorneys sent the case to state prosecutors. The attorney general's office sent it back saying they don't have the funds or manpower to handle it. Nacogdoches County Attorney John Fleming, who once employed Kerss' stepson, asked for a special prosecutor. Jimerson said he's working on it, but will be very busy on his own county's cases until after November. Kerss resigned from her position following the graduation night incident.

Witnesses during the disturbance said Kerss had used a chemical agent on at least two individuals.
