Diboll man charged with indecency in bathtub case

ANGELINA COUNTY, Texas (KTRE) - A Diboll man was arrested Tuesday on an accusation that he touched a 13-year-old girl inappropriately while bathing her.

According to an arrest affidavit, the girl told an investigator with the Angelina County Sheriff's Office that Jose Heriberto Mendoza, 40, had been touching her inappropriately ever since she was 11. The girl told her best friend about it, who told her grandmother. The grandmother then told the victim's school counselor, who contacted Child Protective Services and the mother of the girl.

Inv. Charlie Harris set up an interview with the Angelina Alliance for Children. The interview was conducted on Oct. 21 and the girl described how Mendoza would come into the bathroom with her and would wash her and touch her while bathing her. She also said he would also touch her inappropriately while she was in bed.

Mendoza is charged with indecency with a child, a second-degree felony. His bond is set at $75,000.

Angelina County child advocates say about 95 percent of the sexual abuse cases they see are caused by a relative or a close friend.

"It's important that children know in spite of everything, in spite of what's happened, in spite of how this divides a family, even if it's temporary, that what they did by telling was the right thing," said Angelina Alliance for Children Program Director Amy Donahoe.
