Elderly men suing City of Diboll, officer over police stop

LUFKIN, TX (KTRE) - LUFKIN, Texas (KTRE) - Two men who say their rights were violated during a traffic stop are suing the City of Diboll and a former Diboll Police officer.

According to the lawsuit filed in the 159th District Court, Johnny Hodge and Tracey Lott allege former officer Grant Jones violated their 14th and 18th Amendment rights.

In addition to Jones and the city, they also named Police Chief Kent Havard in the lawsuit, saying he failed to properly train Jones.

Lott was driving Hodge to a Lufkin hospital from Seven Oaks in July when Jones pulled him over after chasing him for several miles. A surveillance video shows Jones use a baton to break the pickup window and place Jones in handcuffs.

Jones resigned from the police department in July.
