LUFKIN, TX (KTRE) - By Morgan Thomas - email
LUFKIN, Texas (KTRE) - Not guilty of sexually assaulting a 16 year-old girl. It was a shocking verdict for many in the courtroom. It took the jury about two hours to reach the verdict for Felix Aguirre, 46.
One family left in tears, followed out by a devastated prosecutor. The other family thrilled the ordeal was finally over.
"I think just the truth happened. The truth came out," said Jaime Huera, Felix's nephew.
Felix Aguirre's defense attorney Ryan Deaton says it wasn't easy.
"Oh lord, the greatest challenge in this case was just the fact that everybody spoke Spanish and I don't speak Spanish," said Deaton.
He credits his expert team with helping overcome the challenges.
"We had to get a translator. We had a good private investigator working on the case. We had a guy who reviewed the tapes to tell us if there were any problems with the tapes," said Deaton.
Deaton says the jury must have really listened to their defense, but they also must have noticed the unwavering support of the Aguirre family.
"This family is a good family. They are. I think that probably came across to the jury. These people are hard-working people. They don't break the law," said Deaton.
Aguirre's brother-in-law Charles Cherry says the inconsistencies in the state's case made all the difference, specifically, an alleged confession recorded by the victim's family.
"For instance, the attorney asked her where the tape recorder was at it was underneath the pads and when they asked the daughter she said it was on the table. They didn't have their stories straight from the get go," said Charles Cherry.
Despite a language barrier, Aguirre's brother hopes the jury understands his thanks for bring a family justice.
A grand jury indicted Aguirre of the crime in June of 2010.
The trial began Wednesday, with the alleged victim taking the stand, saying Aguirre repeatedly raped her.
Aguirre returned to the Angelina County Jail, due to immigration officials having a hold on him.
