Trial begins for Diboll man accused of making kids imitate porn

LUFKIN, TX (KTRE) – Wesley Parish, 52, watched a 7-year-old boy tell jurors Parish made him watch a pornographic film and perform sexual acts with his own sister.

The state said Parish, their babysitter, made a young girl perform sexual acts on the boy and on Parish.

Inside the courtroom using dolls and pictures, the boy was able to somewhat describe the sexual acts he claims Parish made the girl do to him.

The children's parents found out about the allegations after the boy urinated outside with his sister watching.

The parents began questioning the children and the stepfather testified, "John Doe said they had kissed before, then he told me that she had performed oral sex on him before and also Wesley."

"Parents do know their children," said Licensed Professional Counselor and Licensed Marriage and Family Therapist Doctor Debra Burton. "They know their personality. They know their typical way of acting or interacting and so if a parent sees something that is kind of a significant change from the norm, you know when we look for signs of sexual abuse, you look at physical, emotional, and behavioral changes."

The Lufkin counselor said once a child does come forward, parents should stay calm.

"Don't ask a lot of specific questions, but it's okay to ask some open-ended questions, real gentle questions like, well just tell me what happened," said Burton.

Burton said the best prevention is educating your children and talking to them about good and bad touches.

"It also sets up a scenario where if something does happen to a child, they might feel more comfortable going to their parents and telling," said Burton.

Although a jury will decide if Parish is guilty of forcing the children in his care to commit sexual acts, Burton said with the proper counseling children like Jane and John Doe can recover from sexual abuse.

Testimony began in the trial of a Diboll man accused of forcing two children he was babysitting to watch pornography and perform sexual acts on him and each other.

Wesley Don Parish, 52, was indicted in December on two counts of aggravated sexual assault of a child and one count of indecency with a child.

First Assistant District Attorney Art Bauereiss told jurors that back in September two children told their parents they were sexually assaulted by their babysitter. The children will be referred to as Jane and John Doe in an effort to protect their identity.

Bauereiss told jurors they would hear Jane Doe exposed herself to John Doe and on occasion had been made to perform oral sex on her younger brother and on Parish.

The state told the jury they would also hear evidence that suggests Parish showed the children a pornographic tape. Bauereiss said detectives searched Parish's vehicle and found the porn tape.

Defense attorney Al Charanza reserved the right to present opening statements later when the state closes.

The state's first witness, a Hudson resident, testified he lives with his common-law wife and her two children.

He said the defendant babysat for Jane and John Doe.

The witness testified Jane Doe is the older child.

He said several months ago, John Doe was standing and it looked like he was urinating in their yard. He said he noticed Jane Doe watching John Doe. He told jurors it surprised him.

The witness testified he called John Doe in the house and began asking him questions. He said John Doe admitted he was urinating in front of Jane Doe.

"They know not to do that," said the witness.

He said he spanked John Doe with a belt.

"I had him sit on the bed and I called his sister in," the witness testified.

He said he then called Jane Doe in the house and asked if she was watching John Doe urinate. The witness testified Jane Doe admitted she was watching John Doe, so he spanked her too.

"I went back into John Doe's room and then started my lecture," said the witness.

He told jurors he asked John Doe if he had ever done anything like that before. He said John Doe began talking about how Jane Doe had shown her bottom to him in the woods.

 "He just started spilling his guts," the witness told the jury."He said that they had kissed before, then he told me that she had performed oral sex on him before and also Wesley."

"Pretty much freaked out," the witness said of his reaction. He said he cried and Jane Doe admitted John Doe's story was true. The witness said he got mad and threw a chair on the floor, then called the police "pretty much right away."

The witness said the last time Parish babysat Jane and John Doe was when he and his common-law wife went to a concert in the Woodlands.

The witness testified they trusted Parish.

"We never thought he would take them anywhere unsafe or do anything wrong," he said.

Charanza began questioning the witness about his relationship to Parish.

In cross-examination, Charanza asked the witness if he was raising his voice when he caught John Doe urinating.

The witness testified John Doe never gave him a description or location when he told him he had kissed Jane Doe before.

"He said that Jane Doe had performed oral sex on the defendant," said the witness.

"This upset you so much; you actually went into the kitchen and threw a chair," said Charanza.

"Sir, whenever you find out that your children have possibly been molested, a lot of people do a lot worse than that," said the witness.

Charanza asked the witness about his knowledge of Parish's health condition.

"He's had two heart transplants," the witness said of Parish.

The witness said the defendant had babysat the children "plenty of times."

Charanza pointed out Parish had watched several other children in their extended family, but there had never been any allegations like these brought up before.

Bauereiss pointed out the children had never recanted their story and remained persistent in their claims against the defendant.

Outside the presence of the jury, the mother of the two children testified Jane and John Doe told her Parish had shown them a porn video.

"Personally I had never seen her like that before," the woman said of Jane Doe. She said Jane Doe had a hard time talking about the alleged incidents.

She said Jane Doe eventually told her Parish had touched her on her private parts and said they had watched a pornographic movie.

Charanza began questioning the witness, who said the police were called immediately upon finding out about the alleged sexual assaults.

She testified her son was outside exposing himself urinating while her daughter was watching. The witness said she had never seen her children do anything like that before.

"When they talk about it with me, their story has not changed one bit," the mother testified.

The witness testified she was very upset when she found out about the allegations.

"I wanted to kill him," she said crying.

She admitted John and Jane Doe have lied to her before and she punished them for it.

The defense questioned her about the children being frightened when they came forward.

 "Any kid is going to get scared when he gets in trouble," she said.

She said John and Jane Doe were both scared and they thought they were in trouble when they talked about the allegations.

The state asked if the children have ever lied about things big enough to land them in court. She said no and usually when they lied it was a white lie to get them out of trouble.

 John Doe began testifying Wednesday afternoon. The 7-year-old testified the defendant was over at his house "lots of times…because he was doing bad things to us."

"He's done lots of things that I didn't like," said John Doe.

He said Parish touched Jane Doe in a way he didn't like.

"He made [Jane Doe] touch my private parts," said the little boy. He testified it happened more than once.

John Doe demonstrated with dolls how the sexual act occurred. 

"He wouldn't let us stop," said the little boy.

John Doe testified that Parish made him watch a real movie. He said it was a bad movie.  He said that "s-e-x" was going on in the video.

He said the people in the movie were doing lots of things to each other.

He said he kept it a secret because Parish threatened them.

"[Parish] said you would get a whooping every single time he was babysitting us," said John Doe.

Bauereiss again gave him dolls to explain exactly what he meant.  He said it made him feel bad and he wished it would quit.
