Woman who had affair with teen gets out of prison, begins probation

BEAUMONT, TX (News Release) - NACOGDOCHES, Texas (KTRE) - For the last two years she's been in prison, completing a two-year sentence for sexually assaulting a 15-year-old girl. Now, she begins her probation sentence.

Tammy Butler pleaded guilty in Dec. 2009 of having an affair with the teenager. Later, Butler's husband, Marlin Butler, was accused of joining the two women together for sexual encounters.

Friday, Butler stepped off the inmate van to go before the judge to be placed on probation for a second count of sexual assault.

Inside the courtroom the woman casually visited with her mother while waiting for proceedings to begin.

Now Butler begins a ten-year probated sentence.

"Tammy has always been remorseful over what happened and she just wants to get back and be with her family," said her attorney, John Boundy. "And i suspect that's what she's gonna do. She's gonna go home, be a productive member of society, live with her family and comply with everything probation wants her to do."

District Judge Ed Klein gave butler a stern presentation of some of the terms of her probation.

She must register as a sex offender. She can't have any contact with the victim, she must stay away from children , receive psychological counseling and get a job or go to school.

While in prison, Butler got her GED and is preparing to attend community college.

She will be living in warren.

State charges against marlin butler were dismissed. He recently pleaded guilty to federal charges on a non-related matter. His sentencing is in June.

The two are still married. Butler said her husband won't sign the divorce papers.
