LUFKIN, TX (KTRE) - An Angelina County Grand Jury handed up 49 indictments last week, including one for a former Livingston music minister accused of using a cellphone to photograph female co-workers at a Lufkin business.
Nathan Scott Kesler, 35, was arrested in November on three counts of improper photography.
A female co-worker at Lufkin Dollar King, which Kesler worked as a store manager, said she had used the restroom and noticed the phone on a shelf positioned in such a way that it would record her with the built-in camera. The woman said she left the restroom and was approached by another female employee who said she saw the phone in the restroom.
The woman told police she then saw Kesler, who was a manager at the store, go into the restroom and lock the door, then leave the restroom. The woman then went back into the restroom and saw that the phone had been repositioned.
Police detectives obtained a search warrant which authorized them to search the content of the phone.
After an interview with Kesler, detectives used search warrants to search Kesler's e-mail accounts and found multiple images from the restroom. The images showed two female employees and a child in the restroom, and Kesler placing the phone in the restroom, according to the report.
Detectives obtained an arrest warrant for Kesler and a search warrant to seize any and all electronic evidence from the home and vehicles of Kesler.
Kesler worked as a minister of music at a Livingston church, but appears to no longer be on the staff, according to the church's website.
Among the other indictments issued last week:
* Earline Ester Garcia, 26, of Lufkin, for aggravated robbery: According to a police report, an officer responded to Brookshire Brothers, located in the 800 block of North Timberland Drive, in reference to a theft. When the officer arrived he learned the suspect, identified as Garcia, had fled the area. An employee told the officer he saw Garcia conceal merchandise in her purse and exited the store without paying. The employee followed her to her vehicle and demanded she return the merchandise. According to the report, Garcia gave him three packages of Orajel and one bottle of QC Pain Relief tablets. When the employee told her police had been notified, he said she left the parking lot in her vehicle, twice trying to strike him with the vehicle.
* Jose Otillio Diaz Jr., 35, of Lufkin, for attempted sexual assault: According to an arrest warrant affidavit, the victim was sleeping in her bedroom at Acadia Arms Apartments, located at 1806 E. Denman on Jan. 6 while her roommate was in the living room. The roommate answered the door and Diaz was there and asked to come in the apartment to fix the dishwasher and check on the heater and thermostat. The roommate let him in and told him the victim was asleep in another room, so that he would not wake her. The roommate went to the master bedroom and heard screams a few minutes later. The roommate grabbed a pistol and ran to the bedroom and saw Diaz standing over the victim's bed, according to the affidavit. The victim was crying and telling Diaz to stop, according to the affidavit. The roommate told Diaz to get out of the apartment and she followed him out. The victim told the roommate she woke up to Diaz pulling off her shorts and felt that he would have continued the assault if she had not helped her.
