NACOGDOCHES COUNTY, TX (KTRE) - A theft of firearm charge has been dropped for a Huntington man who a deputy found with the weapon early Sunday.
A Nacogdoches County deputy arrested Rodney Willis Durham, 30, on the charge.
The deputy found the stolen gun under Durham's driver's side seat in the parking lot of a business on U.S. 59 South and arrested him. However, Sheriff Thomas Kerss said the charge was dropped after it became apparent that Durham had bought the gun from someone a couple years ago, not knowing it was stolen.
Kerss said because the gun was reported stolen out of Angelina County, the charge would have come from that sheriff's office.
