LUFKIN, TX (KTRE) - Lufkin Police arrested a homeless Lufkin man Monday night after being seen on surveillance tape for stealing and consuming alcohol without paying for it.
According to the report, an employee of a business on South Timberland Drive reported to police that an unidentified male suspect stole merchandise and left. Police reviewed the security video and found that the suspect carried an eight-count package of beer into the business' restroom, concealed the cans within his backpack, and then left the business.
Police located Larry Lee Penick, 50, on Tulane Drive. According to police reports, he was consuming one of the stolen cans of beer and had another opened. Police discovered three more cans in his backpack. The officers detected a strong odor of alcoholic beverage on Penick.
Penick failed field sobriety tests, according to the reports.
Penick was booked into Angelina County Jail for the offenses of theft and public intoxication. Because of at least two previous convictions of the offense of theft, the penalty for this incident was enhanced to a state jail felony.
