ANGELINA COUNTY, TX (KTRE) - An Etoile man pleaded guilty Wednesday morning for attacking a man who was only checking to see if he was OK.
Bryan Lee Fancher, 45, accepted a one-year county jail sentence, pleading guilty to a lesser misdemeanor charge.
Fancher was originally charged with felony assault in April after he attacked Duane Lout, who works as a fire chief in Shelbyville. Lout said he had seen Fancher lying on the road on State Highway 103 and stopped to check on him.
That is when he said Fancher jumped up and began beating on him.
Delois Lout, Duane Lout's wife, said she tried to nudge Fancher with her car to distract him, but Fancher tried to get in the car with her. Duane Lout, who suffered some severe facial injuries, managed to stop Fancher. Fancher then ran away, Delois Lout said.
Deputies managed to arrest Fancher further down the road.
Prosecuting Attorney Layne Thompson explained that the state had to downgrade the charge to a misdemeanor because Lout did not suffer a serious bodily injury.
