SAN AUGUSTINE COUNTY, TX (KTRE) -

A San Augustine man charged with the sexual assault of a 16-year-old girl is back behind bars on a child pornography charge.

San Augustine County Chief Deputy Gary Cunningham said the investigation into the charge began in June, after someone shot Billy Gene Childress, 55. Deputies recovered his cellphone, on which he had child pornography.

Deputies obtained a warrant for his arrest, but waited until Monday to arrest him to give him time to heal from the shooting.

Cunningham said the photos were connected to the sexual assault case, in which Childress and his daughter, Margaret Ann Childress, 22, were arrested for in May.

The sheriff's office began investigating the case when officials at a school in the county reported rumors of the girl having a sexual relationship with an adult.

Authorities conducted an investigation and determined the rumors were valid and collected evidence in the case, Cunningham said. They then interviewed the victim and Cunningham said she admitted to the relationship.

Cunningham said the relationship began in early 2010. Margaret Childress would pick up the girl from school on Fridays and take her to her and her father's house. Billy Childress would have sex and sleep in his bed at nights and Margaret Childress would bring the girl back to school on Mondays, Cunningham said.

As for the shooting, Cunningham said investigators have reached a "dead end" in the investigation.

"We've been unable to identify any other suspects," Cunningham said. "I will tell you the AG's office called and said he had submitted a claim to be compensated for being a victim of a crime, which was denied."

Deputies responded to the shooting in June on FM 1751. Cunningham said they discovered Billy Childress had been shot through the shoulder on his driveway.

The call to 911 came from Margaret Childress, who was present at the time of the shooting, Cunningham said.
