LUFKIN, TX (KTRE) -

An Angelina County grand jury has indicted a man on an attempted murder charge in connection to a shooting in 2002.

According to Assistant District Attorney Katrina Carswell, Juan Carlos Garcia, 33, was originally charged in 2002 with aggravated assault. But because law enforcement has not been able to track him down since the incident occurred, the statute of limitations expired after three years.

"For some reason we came across that case again and determined we could file a charge of attempted murder," Carswell said.

The new charge carries no statute of limitations.

Carswell said the charge stems from Garcia shooting someone in the eyes with a gun.

Garcia is a Hispanic man, who in 2002 weighed 154 pounds and was 5'6", according to Angelina County Jail records.

The incident was investigated by the Angelina County Sheriff's Office.
