Verdict Reached In Civil Lawsuit

After 15 hours of deliberation, a Nacogdoches County jury has reached a verdict in a wrongful death lawsuit. The jury ruled in favor of the parents of three children who died in a wreck three years ago and they concluded that several parties were responsible for that accident.

The jury found the Texas Department of Transportation 60 % negligent for the accident, which happened at the intersection of Highways 21 east and 95 near Chireno.

The plaintiffs argued that the state failed to clear some trees that blocked the sight line at a stop sign.

17-year-old Wayne Hailey, his 9-year-old brother, Casey Pate and 15-year-old Heather Anderson died when the truck Hailey was driving pulled into the path of an 18-wheeler.

Hailey was found 40 percent negligent for the wreck. The jury found no fault with the truck driver.

The jury awarded each parent of Casey Pate and Heather Anderson $300,000. But the state has a $500,000 dollar cap on awards. If there is no appeal, the money will be divided among each parent.
