SAN AUGUSTINE, TX (KTRE) - A San Augustine man who has been in jail since August is out on a personal recognizance bond following a court hearing last week.
San Augustine County District Attorney Kevin Dutton said that his office did not oppose the motion to release Billy Gene Childress on charges of sexual assault of a child and possession of child pornography because he does not feel Childress is a flight risk.
Childress was charged earlier this year with sexual assault of a child after investigators with the San Augustine County Sheriff's Office determined he was having a sexual relationship with a 16-year-old girl. The pornography charge came during another investigation when they reported finding pornographic images of a girl on his cellphone.
Childress was re-arrested in August after his bail bondsman forfeited his bond.
Dutton explained that Childress could not afford to post a $40,000 bond and that it would be a long time before the case could go to trial. He explained that a PR bond means Childress does not have to pay to get out of jail, but he is trusted to make all his court appearances. If he violates that trust, he will have to pay the full bond.
