DPS: Livingston man high on Xanax kills man in parked car

POLK COUNTY, TX (KTRE) -

A Livingston man died Thursday morning after the vehicle in which he was parked was slammed from behind by another vehicle. The other driver was arrested later Thursday after troopers determined he was high on Xanax.

Russell James Pinckard, 49, died at 10:55 a.m. at a Livingston hospital.

According to the DPS report, Pinckard was parked in a 2007 Ford Taurus on the shoulder of U.S. 190 at 9:20 a.m. when he was hit from behind by a westbound 2008 Chevy pickup, driven by Ryan Edward Foley, 26, of Livingston.

Foley was treated and released for a chest injury at a Livingston hospital. He was then arrested on a charge of intoxication manslaughter. According to DPS spokesman David Hendry, the investigating trooper determined Foley was intoxicated after finding Xanax pills in the pickup.

Both men were wearing seatbelts.
