TRINITY COUNTY, TX (KTRE) -

A Trinity County Constable has seized a moonshine distillery and will seek a warrant for the arrest of a 20-year-old Trinity man in connection to the illegal device.

Constable Woody Wallace said his deputies were investigating a burglary on Wednesday when they arrived at a house in Lake L Subdivision with the 20-year-old and two 17-year-olds. They asked to search the residence but were refused.

Wallace said they could smell marijuana and see beer in plain view and sought a search warrant to see if there was any marijuana, stolen items or alcohol (since they were underage).

Wallace said they searched the residence and found a moonshine distillery in the garage.

"We didn't really know what we could do with it but we took it since they were underage," Wallace said.

Wallace explained he called TABC about the distillery and a lieutenant from Lufkin called him back and said producing moonshine is a Class A misdemeanor.

Wallace called it a very unusual finding.

"In fact, that lieutenant told me it's only the third time he's come across one," Wallace said.

Wallace said they will work on obtaining a warrant for the 20-year-old's arrest.

Wallace explained that moonshine is pure alcohol and can be dangerous to make.

"If you don't do it right, it can produce poison," he said.
