Judge sends Lufkin child-porn suspect to be evaluated

LUFKIN, TX (KTRE) -

A judge has approved sending a Lufkin man to a psychiatric hospital for evaluation before he stands trial on child pornography charges.

District Judge Barry Bryan approved the motion on Thursday. Once David Allen Smith, 68, is declared mentally competent, he will return to Angelina County to enter a plea or go to trial.

The investigation began on July 6, 2011, after an employee at Best Buy, located in the 4500 block of South Medford Drive, reported to police that they discovered files on a computer hard drive that had file names that insinuated child pornography.

According to Det. Otis Almond, Smith's wife brought the hard drive to the store to have files transferred to a new hard drive. The employee called police and reported the suspicious filed. Almond said neither the employee nor the responding police officer opened the files, but the officer took the hard drive.

Almond said he executed a search warrant on the hard drive on Thursday and found pornographic images of children.

Almond interviewed Smith on Tuesday and said that he confessed to having the pornographic images. Almond arrested Smith on the charge the same day.

Smith is charged with five counts of second-degree possession with intent to promote child pornography.
