WELLS, TX (KTRE) - State troopers arrested a Cleveland man for driving without a license after he hit two boys riding a motorized scooter in Wells, killing one. He likely will not face any other criminal charges.
Randall Nicholas Richard, 34, was booked into the Cherokee County Jail on Thursday.
According to Cpl. Tyson Metzig, said Richards was likely not speeding illegally on County Road 2734, because there was not a posted speed limit sign on the road. Under Texas law, motorists can travel up to 60 miles-per-hour on unmarked roads during the day.
David Stone Jr., 12, and Davion Stone, 6, were driving a motorized scooter on County Road 2734, which is off of US 69, and were hit by Richard's northbound 1999 Honda Accord, which was on County Road 2741, right before 1 p.m.
David died at the scene. Davion is listed in stable condition at a Shreveport hospital.
Metzig said it is illegal to use a motorized scooter on a public road and the boys may have illegally ran the stop sign.
