DPS concludes investigation into Wells accident that killed 12 year old boy

WELLS, TX (KTRE) - DPS investigators have determined no additional charges will be brought against Randall Nicholas Richard, 34, of Cleveland following a fatal accident in Wells that killed one boy and injured his brother.

Investigators say Richard was driving his 1999 Honda Accord northbound with a suspended license last Thursday when he hit the two brothers who were riding on a motorized bike along Cherokee County Road 2734.  DPS troopers also said Richard did not have a current vehicle registration or inspection sticker.  They determined Richard's speed was not a contributing factor to the accident.

In addition, investigators found the children were illegally riding the scooter on a public road and failed to yield the right of way at a stop sign near the corner of County Road 2734 and County Road 2741.

David Stone Jr. who had just turned 12 on June 8 died at the scene.  His brother, Davion, 6, was flown by helicopter in critical but stable condition to LSU hospital in Shreveport where he was treated.  Davion was released from the hospital this week and returned home to Wells as their family finalizes funeral arrangements.

The Wells community and school district have displayed an outpouring of support, including a fundraiser held Tuesday to help with medical and funeral expenses.

Funeral services will be held Saturday at 11 a.m. at Wells High School basketball gym.  The wake is Friday night from 6 - 8 at Wells Baptist Church.
