LUFKIN, TX (KTRE) - A Lufkin man serving a probation sentence for punching his elderly grandfather will be in jail until he goes to a state rehabilitation facility.
Edgar Jesus Ochoa, 21, was re-arrested on July 2, after the Angelina County Probation Department filed a violation report with the district attorney's office, alleging Ochoa tested positive for drugs, did not report to his supervision officer for several months, did not pay his fees and did not complete his anger management courses.
Judge Gerald Goodwin determined Friday morning that Ochoa will have to remain in the Angelina County Jail until a state rehabilitation center accepts him. He will be in the center for either 90 or 120 days.
Ochoa pleaded guilty in January to a charge of injury to the elderly. Deputies with the Angelina County Sheriff's Office arrested him in January 2011, after he punched his grandfather in the face during an argument.
