NACOGDOCHES COUNTY, TX (KTRE) - A deputy arrested three Nacogdoches men after he reportedly caught them trying to steal raliroad equipment near a railroad track early Tuesday.
Dimettron Deleon Buckley, 22, Decorian Forney, 18, and Marvin Charles Jimmerson III, 24, are each charged with state-jail felony engaging in organized criminal activity. Forney has an additional misdemeanor B charge of possession of marijuana.
According to an arrest warrant affidavit, a deputy conducted a traffic stop at 3:47 a.m. after seeing a vehicle without its lights on in a dark area near a railroad track. Deputies found several pieces of railroad equipment and all three suspects were extremely dirty "as if they had been moving equipment," according to the report.
According to the report, Forney told deputies that they had seen the metal on the side of the road and decided to take it, "since that is how they make their living."
Buckley told deputies he knew the metal was not his, but they were taking the metal to sell it to a scrap yard.
During a consensual search, deputies found a small bag of suspected marijuana on Forney, according to the report.
