NACOGDOCHES, TX (KTRE) - For two Nacogdoches men, it was a matter of being in the wrong place at the wrong time.
One man was arrested for possession of marijuana and another was charged with public intoxication after a vehicle pulled into a parking space near a Nacogdoches Police officer, who smelled an "odor of fresh marijuana" when the passenger opened his door.
Nicholas Jarel Hawkins, 21, was charged with possession of marijuana, and Steven Lee Meyer, 22, was charged with public intoxication. Both men were arrested at the scene for the misdemeanor charges and taken to the Nacogdoches County Jail. They have since been released.
The incident took place at the Rudy's located at 107 North Street in Nacogdoches at approximately 2:30 a.m. Friday. Lt. Tim Garner of the Nacogdoches Police Department said the marijuana had to have been smoked recently for the officer to be able to smell it as soon as the passenger opened the door.
A "useable" amount of marijuana was found on Hawkins, the vehicle's driver, after the officer got permission to search him and the vehicle.
