Lufkin man who allegedly bit witness gets injured 2 days later

LUFKIN, TX (KTRE) -

Lufkin Police are investigating a case in which a man accused of biting a witness who tried to stop him from stealing an electronic tablet was injured in an altercation Thursday afternoon.

"The suspect stated that he was driving through the area, saw the victim outside of a residence, and then stopped to confront him about another crime that the suspect believed the victim to have committed," Detective J.B. Smith of the Lufkin Police Department said.

Smith said Jose Buenrostro, 20, got in an altercation with Marco Antonio Marines, 31, on East Kerr Street. At some point, Marines struck Buenrostro with "stick-type" object. At that point, Buenrostro fled into the garage of a residence located on East Kerr Avenue.

Later, an unidentified witness saw Marines' vehicle on Ellis Avenue, and an LPD officer spotted Marines walking on foot down Ellis Avenue. When the officer stopped, Marines approached him and admitted that he had just been in a disturbance in the area of East Kerr Avenue.

Buenrostro is being treated at a Lufkin hospital for cuts, scrapes, and bruises to his arm and shoulder. Police have taken Marines in for questioning.

Marines is charged with aggravated assault with a deadly weapon.

Smith said Buenrostro is being investigated in a burglary of a habitation case, which may be what the altercation was about.

Pending his release from the hospital, he will be under arrest for an arrest warrant issued Thursday in connection to a burglary of a habitation incident that allegedly occurred in the 1100 block of Moss Drive at about 2 a.m. Monday. According to Smith, Buenrostro allegedly forced entry into the residence of a past female acquaintance.

Buenrostro was arrested on Tuesday after he tried to steal a Samsung tablet from a man who was getting a refill at a Lufkin McDonald's on the 1100 block of South Timberland Drive.

Witnesses tried to stop Buenrostro, but he bit one of them before he was arrested.
