SMITH COUNTY, TX (KLTV) -

According to Smith County Adult Probation officers, Kelly Gage, 50, of Gun Barrel City was arrested for violations of his bond. Gage was on pre-trial bond supervision.

According to police documents, Gage was charged on October 11, 2012, with public intoxication and assault.  Gun Barrel City police located and arrested him on Oct. 12, and alerted Smith County probation officers of the arrest.

Smith County adult probation notified Judge Kerry Russell of the bond violation, which led Russell to issue a warrant for Gage's arrest. Gage was arrested by Smith County Probation officers on October 25, and remains in Smith County jail.

Gage was arrested in 2011 for allegedly assaulting his wife, Patti McHugh Gage, on Thanksgiving, causing severe head trauma. His wife later died at a Tyler hospital.

He was later released on his own recognizance after there was not enough proof to show that Gage caused the blunt force trauma that ultimately led to his wife's death.

However, on Tuesday, District Attorney Matt Bingham told us that there is new evidence that makes him "feel much more confident about the case."
