Anti-alcohol group files petition, calling recent alcohol election 'fraudulent'

On Tuesday, the group Stand Strong for Tyler filed a petition against the recent alcohol election in Tyler and Precinct 2. 

The petition states, "The Election of November 6, 2012, did not comply with the requirements of Texas law...for lawful local opinion election regarding the off-premise sale of beer and wine. Therefore, the Election is void as a matter of law, and plaintiffs request that the Court deem it void."

Members of the anti-alcohol group, Stand Strong for Tyler, mailed in the petition on Friday, and it was filed Tuesday afternoon. 

The group states in the 14 page petition that Tyler and Smith County failed to properly certify to the City Council for Tyler and Commissioners Court for Smith County the correct number of qualified voters signing the petitions for the questioned election as required by Texas law. 

It goes on to say, "The authorities for Tyler and Smith County engaged in illegal conduct or mistake by accepting the Petitions in question, upon information and belief, not verifying each signature on the Petitions, and not verifying that statutory requirements as to the petitions were complied with by such offices."

The petition includes pages tabulated by Smith County that are allegedly missing the requisite date of issuance. The petition states, "Smith County tabulated and verified 3,733 signatures that are on petitions forms that are strictly prohibited."
