NACOGDOCHES, TX (KTRE) -
A
23-year-old Nacogdoches man was arrested for prescription fraud when he
allegedly tried to get a third refill on a vicodin prescription his doctor had
specified that no refills would be allowed.
Zachary
Napier is still being held in the Nacogdoches County Jail on a third-degree
felony charge of fraudulent possession of a controlled substance/prescription.
No bond has been set at this time.
According
to the arrest affidavit, a representative of a local doctor's office contacted the
Nacogdoches Police Department and informed the officer who took the call that
the office issued Napier a prescription for vicodin on Nov. 8 that specified no
refills were allowed. However, when the Nacogdoches Walgreens received the
prescription, it had the number 2 marked in the refills section.
Napier allegedly
returned to the drug store for a second refill on a prescription that was not
to be refilled on Nov. 11, according to the arrest affidavit. Then, on Nov. 14,
Napier reportedly called in a third refill for the same prescription.
At that
time, a Walgreens representative called the doctor's office and advised them
that a third prescription had been called in to the store. The doctor's office
told the drug store representative that the original prescription was for no
refills.
While the
NPD officer was at Walgreens investigating the case, Napier showed up at the
drug store to pick up his third refill. Later, the officer obtained a carbon
copy of the original prescription, which said there was to be no refills, along
with the prescription that Napier had that showed two refills.
