Pedi-cab victim's father speaks out

SCOTTSDALE, AZ (CBS5) -

Two Kansas State fans in the Valley for last night's Fiesta Bowl remain in the hospital in pretty tough shape after a suspected drunk driver rear-ended the pedi-cab they were riding in on the way back to their hotel.

The father of one of the victims told CBS 5 News he got a call in the middle of the night about the accident all the way in North Dakota. Joel Tysver said he's now trying to get down to Phoenix as fast as he can.

Tysver said his son Michael Tysver turned 21 years old and was celebrating with a friend in Old Town Scottsdale after the Fiesta Bowl. But the night of celebration turned into something much worse.

Police say the accident happened just after 3 a.m. Michael Tysver and his friend Cody Clark were in a pedi-cab going northbound on Scottsdale road just north of MacDonald when suspected drunk driver Joseph Spano allegedly rear-ended them.

Michael Tysver, Clark and the pedi-cab driver were taken to the hospital.

"It hurts bad and I'm 2,000 miles away and my kids in pain and I can't get there fast enough," said Joel Tysver.

Spano was not seriously injured and was arrested. The pedi-cab driver only had minor injuries. Joel Tysver said his son was celebrating last night.  

"He turned 21 at midnight and they were in town for that Kansas State game. He bleeds purple. He's a huge Kansas State fan. He was planning on going there in the fall," he said.

Joel Tysver said his son pulled through his first of many surgeries.

"He had separation of the spinal column and the brain stem. He's in critical condition," he said,

Joel Tysver said Michael's friend Clark is also in pretty bad shape.

"I'll tell you what, these are two great kids and they didn't deserve this man. They didn't deserve it. What a great 21st birthday present, you know?" he said.

Joel Tysver will be flying into Phoenix late Friday night so that he can be with his son before he goes into surgery tomorrow.

This isn't the first time a suspected drunk driver did damage to their family. Joel Tysver said Michael's uncle was killed a couple of years ago by a drunk driver and that Michael was in the car just a few minutes prior to that deadly accident.

    More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
