The retired Tyler dentist accused of murdering his wife on June 29, 2012 was in court Monday for one of the last hearings before his trial.

Bobby Nichols is charged with killing his wife, 71-year-old Rosalind Nichols. Police said an argument behind closed doors that evening led to Rosalind's death.

At the hearing, the state asked Judge Kerry Russell to revoke and increase the bond for Bobby Nichols. The state said they had bank records showing that Nichols violated the terms of his bond by purchasing alcohol. Nichols took the stand explaining that the alcohol was for someone else and he did not drink any. Because the trial begins Tuesday, Judge Russell did not take action, though he did question why this was not brought to his attention earlier.

Monday morning in court, the judge reviewed numerous motions pertaining to Nichols' trial.
He also swore in about three dozen witnesses. Tuesday, the judge will recall Nichols' case to make sure the attorneys, the defendant and witnesses are all prepared for trial. A jury will be selected Tuesday and opening arguments are expected to begin Tuesday afternoon, with evidence being presented on Wednesday.

Monday, the prosecution told the judge they believe the evidence will show that Nichols' shot and killed his wife and then called 911, admitting what he had done. They say Nichols was fully aware of his actions at the time.

The defense says they do not believe the questions in this case will be whether or not Nichols killed his wife.
