1 man shot dead, suspect hit in head with river rock

Two brothers were arrested Saturday night in connection with an incident that led to the fatal shooting of another brother during a dispute outside a Phoenix apartment, police said.

Mardell and Merrell Curley, both 18, were booked into the Fourth Avenue Jail on charges of aggravated assault.

The victim, Theodore Curley, 17, was found dead outside the apartment near 4200 North 17th Street.

Police released details of their investigation Sunday. The three brothers had been drinking outside at their apartment complex when they began to fight, according to Phoenix police spokesman Sgt. Steve Martos. During the altercation, they began arguing with another teen outside his apartment, Martos said.

The teen eventually went inside his apartment and Theodore Curley turned and walked to his apartment, where he retrieved two knives, Martos said. All three brothers then approached the man's apartment. Theodore Curley attempted to force his way in while making threats, Martos said.

The man inside repeatedly told Theodore Curley to leave and warned him he had a gun, according to Martos. The suspect, fearing for his life and the well-being of his girlfriend and baby who were also in the apartment, opened fire and killed Theodore Curley, Martos said.

The victim's two brothers became upset and began throwing large river rocks into the apartment, Martos said. One of the rocks struck the suspected gunman in the head, police said.

Detectives said they questioned and released the 19-year-old suspect, whose name was not released.

    More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
