LUFKIN, TX (KTRE) -
A Zavalla man accepted a probation deal after pleading guilty Wednesday to driving drunk with a five-year-old passenger in June.
Billy Wayne Powell Sr., 43, accepted a four-year probation sentence instead of serving two years in state jail.
According to a previous report Powell was driving northbound on US 69 South when a trooper stopped him for speeding.
The trooper reported an odor of alcohol on Powell and had him take a field sobriety test, which he failed.
Powell had a five-year-old girl in the vehicle with him. The trooper
arrested him on a charge of state-jail felony driving while intoxicated
with a child passenger.
