PHOENIX (CBS5) -

A woman in Kansas City, MO, is suing a pharmaceutical company after she became pregnant while taking birth control pills.

According to the Kansas City Star, in 2011 Shanta Russell said she learned she was expecting shortly before she got a recall notice from Qualitest Pharmaceuticals.

The company said the pills had been put in the wrong order, making them ineffective.

Russell is suing for the cost of raising her daughter, her healthcare costs and emotional pain.

The company has refused to comment on the case.
