Judge sentences Lufkin man to 10 years for child porn, shock probation possible

LUFKIN, TX (KTRE) -

An Angelina County judge sentenced a 69-year-old Lufkin man to 10 years in prison Tuesday after the man pleaded guilty to possessing child pornography, a second-degree felony.

According to the Angelina County District Attorney's Office, Smith could be considered for shock probation at a later date. Shock probation is a method judges use to rehabilitate convicted felons by putting them in jail then "shocking" them out in hopes they learned their lesson.

Smith appeared in the 217th Judicial District Court Tuesday morning. His court appearance came after he was sent to a psychiatric hospital for a mental health evaluation in May 2012 and declared competent to stand trial.

The investigation began on July 6, 2011, after an employee at Best Buy, located in the 4500 block of South Medford Drive, reported to police that they discovered files on a computer hard drive that had file names that insinuated child pornography.

According to Det. Otis Almond, Smith's wife brought the hard drive to the store to have files transferred to a new hard drive. The employee called police and reported the suspicious files. Almond said neither the employee nor the responding police officer opened the files, but the officer took the hard drive.

Almond said he executed a search warrant on the hard drive a short time late and found pornographic images of children. When Almond interviewed Smith, the man confessed to having the pornographic images. Smith was arrested on five possession of child pornography charges later that day.

    More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
