ETX attorney says West Fertilizer’s insurance won’t even cover his clients’ claims

TYLER, TX (KLTV) -

Hundreds of people are still recovering from the deadly explosion last month at West Fertilizer.

Tyler attorney Randy Roberts' clients are some of them, "They lost everything from their clothing, to their personal effects, to their transportation … their whole life has been turned upside down."

Roberts recently found out West Fertilizer only has $1 million in liability insurance.

"The one million dollars has got to cover all of the injury claims, all of the wrongful death claims, all of the property damage claims, it's not about to make a dent in the catastrophic loss suffered by this community."

Roberts says hazardous business operations, like West Fertilizer, have very few insurance requirements in the state of Texas, "I wasn't surprised when I learned they had minimal insurance. It's just another sign that they were trying to cut corners, save costs, and let other people take the risks."

Roberts is looking at other ways the company can compensate his clients.

"I think you're going to find that the focus of this litigation turns from , 'how did the explosion occur?' to 'who could have prevented it?'"

He has questions for the owners, "Was this astronomical amount of ammonium nitrate being stored at the fertilizer plant for use in the plant's operations? Or was it being stored there on consignment by perhaps other larger corporations who were taking advantage of the lax oversight at this plant?"

Roberts hopes his clients and everyone else affected get the answers they deserve in the next few weeks.

The attorney for Adair Grain, the company that owns West Fertilizer, says the plant does not have excess or umbrella coverage insurance.

Investigators still do not know what caused the explosion.
