E. Texas man arrested for breaking into home, sexually assaulting minor

SMITH COUNTY, TX (KLTV) -

We are learning more about an East Texas man accused of sexually assaulting a minor female. Marcus Allen Edmiston, 26, of Smith County, is behind bars charged with burglary of a habitation with intent to commit sexual assault and failure to identity himself, giving false information to authorities.

This happened in the early hours of June 11 off of South Farm to Market Road 756 in Smith County. 

In this arrest affidavit, the victim, a teenage girl, reportedly told her father that an unknown man broke into her bedroom and sexually assaulted her. 

Smith County Sheriff's Department officials have identified that man as 26-year-old Edmiston of Smith County. 

The victim said Edmiston came into her room, wearing nothing but a cloth and covered her mouth to keep her from screaming. He reportedly told her he would kill everyone if she said anything.

When a deputy arrived at the scene, he reported finding several notes believed to have been written by Edmiston saying quote, "If you say anything, I will poor gas on the house and kill you all."

Deputies also found the cloth the victim said Edmiston was wearing outside of the home along with a syringe deputies believe to be filled with meth, and the victim's cell phone with a missing battery. Deputies said they went through recent phone calls and found out that Edmiston had called another East Texas man trying to sell the victim's property. That man identified the suspect as Edmiston. 

Edmiston fit the description of the suspect the victim had provided. When deputies located Edmiston, he reportedly provided a false name, but eventually admitted that he did remove clothing outside of the victim's home, but did not remember entering the residence. 

He told detectives he was very high on methamphetamine and did not remember much. He now remains behind bars charged with providing false information and burglary of a habitation with intent to commit sexual assault. 

His bond totals $751,000. Smith County Sheriff's officials said Edmiston could faced additional charges pending the results of the investigation.

    More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
