PD: Officer opens fire as gunman points weapon

PHOENIX (CBS5) -

A Phoenix police officer shot and wounded a gunman after the suspect refused orders to drop his weapon, investigators said.

The officer is OK and the suspect was taken to a local hospital and is expected to be fine.

A neighbor called police at around 5:40 a.m. Sunday after seeing a man choking a woman in the driveway of a home in the area of 3000 N. 85th Lane.

When police arrived, officers tried to determine if the woman was injured. The woman refused to cooperate and an officer followed her inside the home, said Phoenix police Officer James Holmes.

Once inside, the woman blocked the doorway, preventing other officers from entering the kitchen area. 

The suspect entered the hallway armed with a handgun, Holmes said.  The 31-year-old officer immediately drew his weapon and began giving commands to the suspect to drop the gun, Holmes said.

The 31-year-old suspect refused to obey and raised the gun in the direction of the officer and the victim. Fearing for their safety, the officer fired his service weapon, striking the suspect, Holmes said. 

As officers were clearing the rest of the home, a 39-year-old man emerged from a bedroom with an apparent gunshot injury to his leg or hip area. He, too, was taken to the hospital and is OK.

Holmes said it's not known how the 39-year-old man suffered a gunshot wound.  

The investigation is continuing.

    More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
