SMITH COUNTY, TX (KLTV) -

A Smith County patrol deputy was arrested Wednesday morning for intent to sell a controlled substance.

According to the Smith County Sheriff's Department, Kimbrick Jones, 38, was arrested in the sally port area of the jail for intending to sell methamphetamine and cocaine. Jones was advised of his charges and told he was terminated.

Jones faces four charges: possession with intent to distribute less than 50 grams of methamphetamine, use and carry of a firearm related to a drug trafficking crime (2 counts) and possession with intent to distribute less than 28 grams of crack cocaine.

Sheriff Smith says Jones had drugs in his patrol car. Officials aren't sure if he was collecting drugs while on duty, but don't believe anyone else is involved.

The sheriff says all of his cases are possibly tainted if he had to testify in them, although most of them are class c misdemeanors.

Jones has been with the sheriff's department since June 2004. He was promoted from detention officer to patrol deputy in 2006. He had previously served with the Dallas County Sheriff's Officer as a jailer from 1997-1998 and the Smith County Sheriff's Office as a jailer from 1998-2001.

He appeared in federal court on Wednesday afternoon. Pending a trial, the U.S. District Attorney asked that Jones be held in jail, since he believes Jones is a flight risk due to the amount of jail time he is facing. If convicted, Jones faces up to 20 years for each drug distribution violation and minimum of five years for a firearms violation.

Jones was presented with two warrants while in court informing him that two animals were  seized from a property under his control. There are no charges at this time, but evidence discovered today could lead to further charges.

Jones is being held in the Gregg County Jail. A detention hearing and preliminary hearing are set for July 15 at 10 a.m.

Members of the FBI, Department of Public Safety and Texas Rangers, along with the Smith County Sheriff's Department, assisted with the arrest.
