3rd trial starts in Tucson teen's shooting death

TUCSON, AZ (AP) -

A third trial has begun in the shooting death of a Tucson teenager nearly 12 years ago.

Max Montijo LaMadrid is accused of killing 16-year-old Tanee Natividad during a drive-by shooting in November 2001.

Natividad was with her boyfriend at a fast-food drive-through when two groups started fighting in the parking lot.

Police say shots were fired and a bullet went through the rear window of the car Natividad was sitting in and fatally struck her in the head.

The 36-year-old LaMadrid was on the run for nearly nine years before he was captured in October 2010 by Mexican authorities in Hermosillo.

Jurors couldn't reach a unanimous verdict in LaMadrid's first two trials on a first-degree murder charge.

The Arizona Daily Star says LaMadrid's latest trial started Tuesday.
