PHOENIX (CBS5) -

Police said a homeowner shot an intruder early Friday morning in Phoenix.

Phoenix police said the suspect broke into the home near 19th Avenue and Thunderbird, while the homeowner was sleeping.

The 54-year-old homeowner woke up, saw the intruder kicking in his bedroom door and fired multiple shots, according to Phoenix police spokesman Tommy Thompson said.

Thompson said the 32-year-old suspect was hit several times by the gunfire. When officers arrived, the suspect was lying in the hall and a handgun was recovered near him.

The suspect is expected to survive. Thompson said charges are pending his release from the hospital.

The homeowner could also face charges.

Thompson said while officers were going through the house to secure it, they found the resident was growing marijuana. He had a medical marijuana card, which limits 12 plants and he had nearly 50 plants.

"This individual had the proper credentials, but the problem was he has more plants than were allowed by permit," Thompson said.

Thompson said charges against the homeowner will be submitted to the Maricopa County Attorney's Office for review.

The Phoenix Police Department HIKE squad, and the Drug Enforcement Bureau Detectives are investigating.

More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
