LUFKIN, TX (KTRE) - Officers with the Lufkin Police Department arrested an 18-year-old man for sexual assault of a child Thursday.
According to the affidavit, Joseph Wayne Moffitt, of Lufkin, allegedly had consensual sex with a 14-year-old girl on July 29. However, according to Texas law, a minor cannot legally give consent to have sex.
Moffitt is still being held in the Angelina County Jail on a second-degree felony charge of sexual assault of a child. No bail has been set at this time.
According to the arrest affidavit, a Lufkin Police Department detective learned from a patrol officer that a 14-year-old girl, referred to as Jane Doe, confessed to her mother and police officers that she had sex with an 18-year-old man, Moffitt.
Jane Doe told the detective that she and another girl knew Moffitt from Facebook and decided to go visit him at his apartment in the 500 block of Lazy Oaks, the affidavit stated. Doe said she and her friend went into Moffitt's bedroom, where Doe got on the bed with the young man and the second girl sat in a nearby chair.
When Doe and Moffitt started kissing, the second girl left the room.
"Jane Doe and Moffitt had consensual sex which lasted 15-20 minutes," the affidavit stated. "After having sex, Jane Doe and [her friend] left the apartment and walked home."
The LPD detective contacted Harold's House and set up a SANE exam. Later, the detective and a patrol officer went to Moffitt's apartment and asked him to tell his version of what happened. The affidavit said Moffitt denied everything at first, but later admitted to having sex with Doe two to three hours earlier that evening.
At the apartment, the LPD officers collected a variety of evidence including bed sheets and a lap top computer.
