NACOGDOCHES, TX (KTRE) - Nacogdoches Police officers arrested a 20-year-old man for robbery and driving while intoxicated after he allegedly stole two six-packs of beer from the Rudy's, threatened a store employee with a tire iron, and tried to drive away in his vehicle early Friday morning.
Zachary C. Smith, of Nacogdoches, is still being held in the Nacogdoches County Jail on a second-degree felony charge of robbery and a Class B misdemeanor charge of driving while intoxicated. Collectively, his bail has been set $16,500.
According to the arrest affidavit, the alleged robbery occurred at approximately 12:49 a.m. Friday. Nacogdoches Police officers responded to the Rudy's convenience store at 3322 Center Highway, where store employees told them they had followed Smith outside the store after he had taken two six-packs of beer without paying for them.
When Smith attempted to leave in his vehicle, one of the store employees tried to stop him. At that point, he allegedly pulled out a tire iron and threatened the store employee, according to the affidavit.
NPD officers stopped Smith's vehicle a short distance away from the convenience store. In the affidavit, the officer stated that he could smell alcohol on Smith's breath. Smith also had glassy eyes and slurred speech. The affidavit stated that Smith admitted to drinking a beer and taking a Xanax earlier that day.
Smith was arrested and taken to the Nacogdoches County Jail for field sobriety tests. Once it was determined that he was intoxicated, he was taken to Nacogdoches Memorial, so that blood sample could be taken.
