Retired Tyler pharmacist arrested following standoff for aggravated sexual assault of a child

Tyler police have arrested James Carey Prosperie, 73, of Tyler, after a standoff at his home on Jeff Davis Drive. 

According to Tyler Police, officers went to Prosperie's home to serve a warrant for aggravated sexual assault of a child at around 11:15 Tuesday morning. When police arrived, officers noticed movement and were able to confirm the man was inside, but Prosperie refused to come out of his house.

Officers on the scene were alerted that Prosperie might be armed and quickly called for backup. Officers, along with Tyler SWAT team members,

"We asked him to come out of the house, but he would not comply," said Tyler Police's Don Martin. "So we used officers along with some of our on-duty SWAT officers to come down to the area and try and talk him out."

Tyler Police spent about an hour and a half on the scene, calling for Propserie to surrender unarmed through a loudspeaker and announcing they had a warrant for his arrest. At about 12:45 p.m., the man finally complied and was arrested in his front yard.

Prosperie had recently retired from a Tyler pharmacy. He has a pharmacy degree from the University of Louisiana - Monroe, where he graduated in 1963. He has had a pharmacy license since August 1963.

Neighbors said he had lived in the home for over 40 years and was one of the original residents on the street.

For parents with children in the neighborhood, the arrest is tough to believe.

"A lot of people have been here since this area was developed," said neighbor Danny Tarpley."There are a lot of kids and small children here. I have two, so it's rather unnerving. I've done the search where you can check out and see who the registered ones are and luckily this neighborhood didn't have any, and I hope it's still that way."

Tarpley said the arrest serves as a reminder for parents.

"Keep a watch on your kids, talk to your kids," he said. "That's how close it can be to you and you will never know it."

Court records show that Prosperie's wife filed for a divorce on August 23 of this year. That trial date was scheduled for Friday, September 6th.

Prosperie was booked into the Smith County jail Tuesday, where he remains on a $100,000 bond.
