MONTGOMERY, AL (WSFA) -

The mother of a baby found wandering in the street won't face criminal charges. Police said while the case was unfortunate, it did not rise to the level of criminal behavior.

"MPD understands that accidents do happen, especially involving young children," said Lt. Regina Duckett, of the Montgomery Police Department. "You've got to keep a very watchful eye at all times."

A Montgomery man captured his encounter with the child on video, and shared the footage with WSFA 12 News. The man came across the child on Brewton Street, off of the heavily traveled Ann Street. The mother, Tamarian McCall, was interviewed by police after the incident, who did not find any evidence of criminal wrongdoing.

"The Montgomery Police Department has not had any history in regard to her and her children. No neglect or any situation we're aware of," said Lt. Regina Duckett, of the Montgomery Police Department. "If this was a continuous issue, if this had been a child and we had been out and located several different occasions, that's going to bring up some red flags with the Montgomery Police Department."

Lt. Duckett said the man, who did wish to be identified, did the right thing by trying to track down the child's parents.

"I would like for him to call 911 immediately though, and have the police show up before the child is released to the mother," she said.

McCall maintains she is a good parent, and her family says she is being targeted by her neighbors.

More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
