PD: Woman beaten, sexually assaulted in Queen Creek

QUEEN CREEK, AZ (CBS5) -

A 44-year-old man is in police custody on suspicion of kidnapping, beating and sexually assaulting a woman in Queen Creek.

A Maricopa County sheriff's official said he was in the area of Ocotillo and Ellsworth roads around 2:40 a.m. Sunday when he saw a scantily-clad woman emerging from an alley and behind her was a man later identified as 44-year-old Todd Smith.

When the law enforcement official turned on his spotlight, the woman started screaming and Smith ran away. Sheriff's deputies detained Smith about a block away.

The victim was able to give deputies a clothing description of her attacker. Deputies noticed the woman suffered a laceration on her left leg and a swollen lump on her forehead which the woman claimed happened when Smith hit her with a wooden stick, a court document stated.

During an interview with deputies, the woman said she had gone behind a business to speak with a friend in one of the suites. When no one answered, she said she turned around and saw a man standing behind her, court paperwork stated.

The man slammed her head up against a wall and then dragged her into a nearby utility shed that was attached to the building, the court document stated. The suspect threatened to kill her as he sexually assaulted her, the court document said.

At some point, the woman said she was able to flee and alert the deputy who first spotted her.

Crime scene technicians arrived and detectives reported there was evidence indicating a struggle. They found the victim's pants and shoes that had been forcibly removed from her, according to court paperwork.  

Detectives also said they located a wooden push broom handle that the woman said was used during the attack.

Smith was booked into jail on one count of sexual assault, one count of kidnapping and one count of aggravated assault.
